Our aim is to be as professional, efficient and courteous as possible with both our customers and suppliers. In these our Standard terms and conditions “we”, “our” and “us” means capetownattractions.com, “you”, “he”, “she”, “customer” means the person making the reservation includes also all bookings made for 2 or more people and includes all the people travelling with you and for the avoidance of doubt any individual you make a booking on behalf of. It is taken that you are the lead contact for your group and therefore all correspondence and conversations in respect of the arrangements for yourself and all members of your group will take place between you and us. These standard terms and conditions shall form the basis of the agreement for you and your group’s holiday and shall apply to the exclusion of any other terms and conditions whether put forward by you, your group or a third party or whether implied by law or statute. No alteration to these conditions shall be effective unless expressly agreed to in writing by the director of capetownattractions.com.

Limited Right to Use .The access, browsing, using, viewing, printing or downloading of any content, graphic, form or document from our site grants you only a limited, non-exclusive license for use solely by you for your own personal use and not for republication, distribution, assignment, sub-license, sale, preparation of derivative works or other use. No part of any content, form or document may be reproduced in any form or integrated into any information retrieval system, electronic or mechanical, other than for your personal use (but not for resale or redistribution).

Copyright. The content, organization, graphics, design, compilation, magnetic translation, digital conversion and other matters related to our site are protected under applicable copyrights, trademarks, registered trademarks and other proprietary (including but not limited to intellectual property) rights. The copying, redistribution, use or publication by you of any such matters or any part of the Site is strictly prohibited.

You do not acquire ownership rights to any content, document or other materials accessed or viewed through our Site. The posting of information or materials on our Site does not constitute a waiver of any right for this information and materials. Nothing on our website should be copied or used for commercial gain without the written consent of the owner.

Acceptance to the Terms and Conditions of Sale.The following sales terms are communicated to each customer every time he/she processes an order on our website. Processing an order implies that the customer adheres to the Terms and Conditions of Sale.

Reservations.In order for us to process your request for reservations fully and provide you with the activity on your suggested date, we advise placing your order a minimum of 20 days prior to your travel date. All reservations are subjected to availability. Any disability requiring special attention should be reported at the time of booking. Capetownattractions.com will make its best to cater for the needs of the disabled tour participant. In making a booking with capetownattractions.com, whether directly through our website or via e-mail or telephone, you and all members of your group have understood and accepted our standard terms and conditions and in case of group bookings (2 persons & more), the person making the booking is responsible for making all members of his or her group aware of these conditions.

Payment system & Payment Methods. Capetownattractions.com uses the “MasterCard” secure online payment system. Online Reservations can only be made with a valid credit card. If you do not want to use our payment system or do not own a credit card, you can always contact us to discuss alternative payment methods. MasterCard guarantees a high level protection when providing your credit card number. Information regarding the latter is not accessible to third parties and is not communicated to capetownattractions.com but is only kept on the secure database of MasterCard. The order confirmed by the client will be considered valid only when approved by “MasterCard”. If MasterCard does not approve the transaction, the order will be automatically cancelled and the client will be informed by email.

Capetownattractions.com does not charge a service fee for processing credit card payments. Full payment by credit card is required to make a reservation. For web orders, only credit cards are accepted. Credit cards accepted are:

  • VISA
  • Mastercard
  • American Express

On special requests and following the confirmation of the owner of capetownattractions.com, it is also possible to pay by bank transfer directly to capetownattractions.com bank account.

Charge-back customers who pull charge back’s *will* be reported to all major credit bureaus as a delinquent collection account.

Prices. Please refer to the product description for the price of each specific Attraction, Activity, Tour and Excursion. Prices advertised on capetownattractions.com include the price of providing the attractions, the cost of handling, reservation fees, credit cards processing fees, clearance fees and local taxes. Unless detailed otherwise in the specification of the activity, these prices do not include transportation, food, beverages, guide, tips/gratuities to tour directors, drivers, and local guides, and do not include any other service which is not detailed in the specification of the activity. As we act only as a booking agent for our suppliers, we and our suppliers reserve the right to change, amend or correct prices shown on our site at any time before or after you have booked. Tours and services are subject to currency fluctuation. After you have booked, if the price of your booking changes in such a way, we will pass on the details of the change as soon as possible. Prices are based on the local tariffs offered by our suppliers. The prices for the activities on the website are in Rands. Child rates are available for children based on the age definition specific to that product.

Products/activities. The product offers are valid within the limits of the availability. These products are offered and supplied to the customer through our suppliers. The photos, illustrations and other promotional material used for the description of the activities are for the purpose of exemplifying products of the same type of activity. We cannot guarantee that all photos advertised and used on this website illustrate the exact attraction as offered by the service provider. The only purpose of these photos is to give the customers a better understanding of the attractions and activities from such category. The descriptions and illustrations on any of our literature and website are given as approximate representations only, and given in good faith. Please note that indicated return times are according to normal road and weather conditions and may change if conditions are unfavorable. CapeTownAttractions.com aims to be accurate on the details shown on its website and in its offers but we make no commitment about the accuracy, reliability, completeness or timeliness of the Material or about the results to be obtained from using our Website and the Material.

Provision of Service. No compensation of any kind or responsibility can be taken if, due to circumstances beyond our or our supplier’s control, for example, when we have to notify a change to your arrangements after departure, or we or our suppliers cannot supply your arrangements in full or in part as agreed, or you suffer any loss, injury, accident, or damage of any description to person or personal property. A circumstance beyond our or our supplier’s control is one that cannot be foreseen or avoided, even after taking all due care and includes but is not limited to war, terrorist activity, civil unrest, industrial disputes, acts of god, natural or nuclear disaster, high level of water, technical or maintenance problems and bad weather situations or forecasts. CapeTownAttractions.com also reserves the right to cancel scheduled tours, attractions and activities at any time in the event of hazardous weather conditions or unforeseen operational problems. CapeTownAttractions.com reserves the right to refuse admission to anyone at its sole discretion.

Open Voucher Validation. – CapeTownAttractions.com offers its customer the option to order an open voucher for a specific Activity, Attraction, Tour and Excursion. The open voucher can only be used for the specific Activity, Attraction, Tour or Excursion for which it has been purchased as detailed on the order confirmation and on the voucher itself. Please note that the Open Voucher is only valid for use for the relevant activity for which it was purchased and is valid for a period of 3 months from the day of its purchase. Meaning, the activity must begin during the 3 months validation period of the open voucher = must go on the activity within a maximum of 3 months from the date of its purchase. In case the customer fails in using the open voucher during the period of 3 month, and fails to go on the Attraction, Activity, Tour or Excursion for which it has been purchased, the open voucher will no longer be of any use or value and it will be void. In case of a void open voucher the customer will not be entitled to receive any refund nor compensation against the payment made to purchase the voucher. This is why we strongly encourage our customers not to wait for the last moment in order to use the open voucher.

Using an Open Voucher for Reserving an Activity. In order for us to process your reservation request in full and provide you with the activity on your preferred date, we strongly advise that you will place your request for reserving the activity a minimum of 20 days prior to the date on which you would like to go/use the activity. All reservations are subjected to availability. In case you request to reserve an Activity, Attraction, Tour or Excursion for a specific date less than 10 days prior to the date on which you would like to go/use the activity, capetownattractions.com cannot guarantee that the customer’s reservation will be confirmed or will be done successfully. Accordingly, for late reservations requests made during the period of the last 10 days of the open voucher validation period (referring to the last 10 days out of the 3 months period), capetownattractions.com, cannot guarantee that these reservations will be confirmed or done successfully. In case capetownattractions.com will not be able to confirm such a late reservations requests, and due to this an open voucher will not be used during the period of 3 months of its validation, the customer will not be entitle to any refund nor compensation against the payment made to purchase this voucher. This is because it is in the customer responsibility to reserve the activity on an earlier stage, while providing capetownattractions.com at least 10 days in order to confirm the booking. This is why we strongly encourage our customers not to wait for the last moment in order to use the open voucher.

Reserving the Activity on a specific preferred date. In order for us to process your order request in full and provide you with the activity you desire on your preferred specific date, we strongly advise that you will order the activity a minimum of 10 days prior to the date on which you would like to go/use the activity. All reservations are subjected to availability. In case you request to reserve an Activity, Attraction, Tour or Excursion for a specific date less than 10 days prior to the date on which you would like to go/use the activity, CapeTownAttractions.com cannot guarantee that the customer’s reservation will be confirmed or will be done successfully.

Complaints and problems. In the unlikely event that you have any reason to complain or in case you experience any problems with your trip, activity or attraction, this must be brought to the attention of the relevant supplier immediately so that action can be taken to remedy the problem. Unfortunately some problems cannot be dealt with quickly. If you remain dissatisfied, however, you must write to us within 28 days of the day of the activity, while mentioning your booking reference and full details of your complaint. The assistance we provide to resolve your complaint is provided on behalf of our suppliers in our capacity as agents only. We will do our best in order to claim from our supplier a full compensation on your behalf. Please note that If you fail to follow this simple complaints procedure, CapeTownAttractions.com will not be able to claim the compensation on your behalf, and accordingly the compensation of which you may otherwise have been entitled to may be affected or even lost as a result.

Damage to or theft of personal belongings.CapeTownAttractions.com cannot be held liable if a client's personal belongings are damaged or stolen during his or her activities. It follows, therefore, that CapeTownAttractions.com is not obliged to reimburse its clients for damages in this regard. Each client has a personal responsibility to take due care and attention by keeping close watch on his or her personal belongings and to refrain from bringing valuables to the activity. CapeTownAttractions.com shall accept no responsibility for the loss of, or damage to, personal property or valuables. Insurance to cover the loss of baggage and valuables is also highly recommended and is not in any means included in any of our activities/trips/or any other.

Liabilities. CapeTownAttractions.com acts as mediator (booking agent) for the relevant suppliers for any service, activity, attraction and/or any other service. CapeTownAttractions.com has no liability of any kind whatsoever to you or your group, or dependants for any death, personal injury, loss, consequential loss or damage of any kind you or your group, or your dependants may suffer unless caused by our own negligence. CapeTownAttractions.com and suppliers also accepts no responsibility or liability whatsoever for any government restraints, acts of war and terrorism, weather conditions, or for any misadventure or casualty or any other force majeure or causes beyond our and the suppliers control. All matters referring to the attractions and activities supplied to the customer are in the sole responsibility of the Service Provider/third party. The Service Provider/third party will be sole responsible for providing the Attraction with due care, making sure that the service he provided will be of the highest quality, while keeping high service standards. By using CapeTownAttractions.com you agree to indemnify CapeTownAttractions.com and its employees against any liability, although we may at our discretion agree to assist in the resolution of problems, and take our own action against any supplier and this party who is in breach of its obligations.

Customer’s behavior. As a customer of capetownattractions.com you are responsible for you and your party’s/group actions and you are expected to respect your environment and other people around you. All suppliers have every right to terminate, your stay or activity under threat of vandalism, violence or any other behavior deemed inappropriate by them. You must not behave in a way which may cause distress or annoyance to others or which may create the risk of danger or damage to property. In any of these cases mentioned hereof all insurances will be invalidated and you will not have any entitlement to a refund, compensation or to cover any of your expenses of any kind whatsoever. In case of damages or loss caused by you or any member of your group, you will be responsible and liable for full payment for these damages. In some activities, such as rafting, diving, etc, capetownattractions.com or our suppliers will request the customer to fill in and sign a waiver. In the case the customer denied to sign on such paper, the supplier could take the decision to exclude the client from that specific activity. No compensation or refund will be given in such a case.

Tickets for Performances, shows, festivals and special events. Tickets for Performances, shows, festivals and special events in any case cannot be cancelled, re-scheduled, or other. We cannot be held responsible to changes of venue or changes of cast made after the booking of your holiday.

Litigation.Any claim or dispute will always be dealt with the best attention, as the person that takes the pains of submitting his claim is presumed to do so in good faith. In case of litigation, the client will at first deal with the company for an amicable solution of the problem. If a solution cannot be found, the South African legal system will be the sole competent legal system.

Applicable rights. The current terms and Conditions are subject to the Mauritian legal system. Any litigation relating to the commercial relationship existing between capetownattractions.com and the client are submitted to the exclusive competence of the South African jurisdictions.
